LAWYERS of Association of Boxing Alliances in the Philippines (Abap) president Ricky Vargas have filed a motion asking the Pasig Regional Trial Court to direct the Philippine Olympic Committee told a special election on February 23.
Vargas' camp filed the motion before Judge Maria Gracia Cadiz-Casaclang of Pasig RTC Branch 155 who declared as null and void a 2016 election that gave Peping Cojuangco a fourth term as president and ordered new polls for president and chairman.
The motion was in reaction to the move by POC lawyers to seek a Temporary Restraining Order on the court’s decision for special elections.
Vargas’ lawyer George S.D. Aquino of the Angara, Abello, Concepcion, Regala, and Cruz Law Firm (Accra Law) said the POC should follow the court’s decision, saying the Pasig RTC decision is “immediately executory.”
"We requested the court to already direct the POC executive board and the election committee to do all necessary acts to effect the election. We believe this is a ministerial act of said POC committee to follow a court order and we are confident said elections will be held forthwith,” said Aquino.
Vargas was disqualified from running from running against Cojuangco in 2016 after the POC elections committee ruled the boxing federation president didn’t meet the ‘active member’ criteria set forth by the POC by-laws.
