NBI recommends criminal charges against Tab Baldwin, 11 others

CRIMINAL charges have been recommended by the National Bureau of Investigation (NBI) against former Ateneo coach Tab Baldwin and 11 other individuals over the ill-fated Blue Eagles team building at Dipaculao, Aurora which cost the lives of Rene Baterbonia and Divine Adili.

NBI Homicide Division chief Romeo Astrero Jr. endorsed to the Department of Justice (DOJ) on Monday the cases of reckless imprudence resulting in two counts of homicide against Baldwin, as well as assistant coaches Jon Jacinto, Dean Castano, Sandro Soriano, and Buboy Domingo, strength and conditioning coaches CJ Elumba and Grant Dearns, and physical therapist Jeric Rueca.

The eight were deemed to have "planned and conducted the water resistance run" which led to the tragic incident last June 8.

Subsequently, criminal charges were also endorsed by the NBI against Ateneo athletic director Em Fernandez, as well as Hermanos Resort operating manager Francisco Zubia III and co-managers Frederick Zubia and Yedda Mary Rubio for simple negligence resulting in two counts of homicide.

    Administrative charges have also been recommended against the responsible officials from the Municipality of Dipaculao, particularly the Business Permits and Licensing Office (BPLO) officer, the Municipal Tourism & Cultural Development officer, and the Municipal Disaster Risk Reduction and Management Office (MDRRMO) head, for alleged regulatory lapses stemming from the incident.

    In a statement, Ateneo assured that it continues to respect the process and "fully cooperate with all lawful investigations."

    Meanwhile, the Department of Labor and Employment (DOLE) is withholding its judgment in relation to the employment setup of Baldwin.

    Ateneo last week clarified that Baldwin was not an employee of the university, but rather only an 'independent consultant.'

    "This contractual arrangement predates the Aurora tragedy by nearly a decade and is reflected in written agreements. The existence of that contractual arrangement is a matter of proven record," the University said in a statement.
