COMMISSIONER Willie Marcial has confirmed that Kyt Jimenez will be handed a PBA ban now that he has seen action for the Zamboanga Valientes in a Dubai tournament without getting a clearance from the league.
Marcial said Jimenez's ongoing stint with the Valientes in the 34th Dubai International Basketball Championship constitutes a breach of the Uniform Player's Contract which the flamboyant guard signed with his PBA club San Miguel.

The former Mavs Phenomenal star agreed to play for the Valientes after being relegated by the Beermen to their unrestricted free agent with rights to salary (UFAWR2S) list with still a year left in the three-year contract he signed with SMB.
Although Jimenez sought the permission of SMB management to play for the Valientes, Marcial explained the No. 76 pick of the Season 47 rookie draft failed to secure a clearance from the PBA Commissioner's Office.

The commissioner said a UPC is a tripartite agreement among the player, his team and the league. Any release should be signed off by all parties, he added.
"Nakapirma ako sa lahat ng players' contracts, since tripartite sila," he explained.
Marcial, however, assured that the PBA door remains open for Jimenez, who can appeal the impending ban if and when he gets another opportunity to sign up with a pro ballclub.
He added the Valientes guard has already reached out to the league.
